HELP WITH THE FOLLOWING:

Fence takes three or more days to dry, please don’t shake or jar fence.
We are responsible for any repairs by our error, but customer is responsible and will be charged for any and all changes to contract.

Contractor will remove broken block and excess raw materials except loose mortar and excavation dirt. If customer requests removal of any excavation dirt or mortar, an extra charge will be billed for said services.

The undersigned hereby accepts the above proposal and offers to employ Progressive Fence Co. Corporation to construct the above specified fence according to the terms and conditions hereof.

Terms and Conditions
1. Property Owner is responsible for removal of any obstacles.
2. All underground sprinkler lines and heads to be marked by Property Owner.
3. Property Owner establishes all fence co-ordinates.
4. PROGRESSIVE FENCE CO. CORPORATION is not responsible for true location of property lines.
5. Due to elevation change it may be necessary to step 'adjust the height) the fence.
6. One half course of block is considered a full course.
7. PROGRESSIVE FENCE CO. CORPORATION is held harmless for damage to underground lines not located by Bluestake.
8. All dirt from footer excavation will be left on job site and not hauled away.
9. PROGRESSIVE FENCE CO. CORPORATION may, of its discretion, engage subcontractors to perform work.
I0. Gate(s), if purchased, are scheduled to be installed after completion of the fence.
11. Property Owner is responsible for obtaining a fence permit if required by the city.
12. Purchaser is the legal owner of the property as listed on the front of this Agreement.
13. All change orders must be in writing and signed by both Property Owner and PROGRESSIVE FENCE CO. CORPORATION
14. Variations in shades of color are inherent in all block used for fencing. No claims will be allowed for these variations.
15. Should any significant hidden defects within the Purchaser's property become apparent after PROGRESSIVE FENCE
CO. CORPORATION commences work, Property Owner agrees to permit PROGRESSIVE FENCE CO. CORPORATION to
suspend work until the parties can agree on extent of the increase of the total purchase price that is required to compensate
PROGRESSIVE FENCE CO. CORPORATION for curing the hidden defect in order to complete the work.
16. Wood products are not warranted.
17. Signatures transmitted by facsimile are considered as binding as an original signature.
18. Upon default of payment according to the terms and conditions stated in this Purchase Agreement, the entire balance is
immediately due and payable with interest at 1-1/2% per month, 18% per annum, from date of default until paid. In the event
it becomes necessary to employ an attorney or collection agency to collect this amount, or any part thereof, it is agreed by
and between the parties that the Property Owners shall be liable for attorney's fees or collection costs plus any court costs
incurred by PROGRESSIVE FENCE CO. CORPORATION. It is further agreed by and between the parties hereto that the title
to the property herein contracted for, including any and all equipment and materials supplied or delivered to the job site and
installed or affixed hereto, shall remain the property of PROGRESSIVE FENCE CO. CORPORATION, the seller, until such time
as this contract is fully performed and all amounts are paid. We further agree that PROGRESSIVE FENCE CO. CORPORATION
shall have the right to perfect any mechanical or materialman's liens as provided by Arizona low, which may be deemed
necessary in order to protect it's interest herein and upon breach of this contract by the Property Owner, in addition to any
other remedy available to seller under Arizona law. PROGRESSIVE FENCE CO. CORPORATION has the right to retake the
property and enter Property Owner's premises in order to effect any right referred herein.
Notice of Cancellation
You may cancel this transaction, without any penalty or obligation, within three business days from the date on
reverse side.
If we commence the job within 3 days of signing contract and been accepted by the company, customer waves the
right to cancel this contract.
To cancel this transaction, mail or deliver a signed and dated copy of this cancellation notice or any other written
notice, or send a telegram to Progressive Fence Co. Corporation, at 400 W. Camelback, #210, Phoenix, Arizona
85013, not later than midnight, three (3) business days after the date of the signed contract (see reverse side for
date of contract).
